Terms of Service
Effective Date: August 2026
These Terms of Service (“Terms”) govern your use of Birdie Booking, including the Birdie Booking website, applications, automated booking services, and related features (collectively, the “Service”).
Birdie Booking is operated by Birdie Booking, LLC (“Birdie Booking,” “we,” “us,” or “our”).
By creating an account, submitting a Booking Request, purchasing a subscription, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use Birdie Booking.
1. What Birdie Booking Does
Birdie Booking is an automated tee-time booking assistant.
You tell us the course, date, number of players, desired time window, and other applicable booking preferences. We then attempt to reserve a tee time that meets those criteria when the applicable course’s booking window opens.
For purposes of these Terms:
- A “Booking Request” is an instruction you submit to Birdie Booking asking us to attempt to reserve a tee time on your behalf.
- A “Tee Time Reservation” is an actual reservation successfully made with a golf course or third-party booking provider.
Birdie Booking is not a golf course, tee-sheet operator, or golf course management company. Unless we specifically tell you otherwise, we are not affiliated with, endorsed by, or acting as an agent of any golf course or third-party booking platform.
We do not own or control the tee sheets, inventory, pricing, policies, websites, or booking systems we access on your behalf.
2. Eligibility and Accounts
You must be at least 18 years old and legally able to enter into a binding agreement to use Birdie Booking.
You must create an account and provide a valid email address to use booking features.
You agree to provide accurate information and keep your account information current.
You are responsible for activity that occurs through your Birdie Booking account. You are also responsible for maintaining the security of your account and any golf course or third-party account credentials you provide to us.
If you believe your Birdie Booking account has been accessed without authorization, contact us promptly.
You may not create an account using false information, impersonate another person, or use an account you are not authorized to use.
3. Authorization to Act on Your Behalf
Birdie Booking works by taking certain booking actions for you.
When you create a Booking Request, you authorize Birdie Booking to take the actions reasonably necessary to attempt to complete that Booking Request on your behalf.
Depending on the course or booking provider, those actions may include:
- accessing a golf course or third-party booking website;
- logging into an account using credentials you have provided;
- searching available tee times;
- selecting a tee time that satisfies your booking criteria;
- selecting player counts, player types, number of holes, or similar booking options;
- submitting a reservation;
- receiving and processing booking confirmation information; and
- taking other steps reasonably necessary to complete the Booking Request you submitted.
You represent that you have the right to access and use any third-party account, credentials, payment method, membership, player profile, or other information you provide for this purpose.
Birdie Booking’s authority is limited to actions reasonably related to the services you request from us.
4. Your Booking Request Is Your Authorization
When you submit a Booking Request, you authorize Birdie Booking to reserve a tee time that satisfies the criteria you selected.
Those criteria may include the:
- golf course;
- date;
- earliest acceptable time;
- latest acceptable time;
- preferred or ideal time;
- number of players;
- number of holes;
- player or membership type; and
- any other options presented when you create the Booking Request.
A Tee Time Reservation does not have to match your ideal or preferred time exactly. Any tee time that falls within the acceptable parameters you submitted may be booked.
For example, if you authorize Birdie Booking to reserve a tee time between 8:00 a.m. and 10:00 a.m., a reservation at 9:42 a.m. is an authorized Tee Time Reservation even if your preferred time was 9:00 a.m.
You are responsible for reviewing your Booking Request before submitting it and for updating or canceling it if your plans change.
5. Bookings Are Attempts, Not Guarantees
A Booking Request is an instruction to try to obtain a Tee Time Reservation. It is not a guarantee that a reservation will be available or successfully completed.
Tee times are limited and may be highly competitive.
A booking attempt may fail for reasons including:
- the requested tee times selling out;
- another golfer completing a reservation first;
- a golf course changing its booking release time;
- a golf course changing its booking rules;
- incorrect or expired account credentials;
- account or membership restrictions;
- booking limits imposed by a course;
- changes to a golf course or booking provider’s website;
- CAPTCHA, security checks, or anti-automation systems;
- website, network, hosting, or third-party service outages;
- payment or account errors;
- unexpected changes in tee-time availability; or
- other circumstances outside Birdie Booking’s reasonable control.
We do not guarantee that we will begin or complete an attempt at an exact second or that Birdie Booking will be faster than another golfer, booking service, or automated system.
A Tee Time Reservation should be considered confirmed only after Birdie Booking or the applicable course or booking provider reports that the reservation has been successfully completed.
6. Your Relationship with the Golf Course
When Birdie Booking successfully reserves a tee time, the resulting Tee Time Reservation is between you and the applicable golf course or booking provider.
The course—not Birdie Booking—determines matters including:
- green fees;
- booking fees;
- deposits;
- taxes;
- cancellation deadlines;
- cancellation charges;
- no-show penalties;
- weather policies;
- membership requirements;
- player eligibility;
- pace-of-play requirements;
- dress codes; and
- other course rules.
You are responsible for complying with those policies.
Birdie Booking cannot waive a golf course’s rules or require a course to provide a refund, credit, replacement tee time, or other accommodation.
A course may cancel, modify, reject, or refuse to honor a Tee Time Reservation for reasons outside our control.
7. Canceling a Booking Request or Tee Time Reservation
There is an important difference between canceling a Booking Request and canceling a Tee Time Reservation.
Canceling a Booking Request
Before Birdie Booking successfully reserves a tee time, you may cancel your scheduled Booking Request through Birdie Booking.
Once the Booking Request is canceled, Birdie Booking will no longer attempt to make that reservation.
You are responsible for canceling a Booking Request before Birdie Booking successfully completes it if your plans change or you no longer want the requested tee time.
Canceling a Tee Time Reservation
Once Birdie Booking successfully reserves a tee time, the Booking Request has been completed and a Tee Time Reservation exists with the applicable golf course or booking provider.
Birdie Booking does not cancel Tee Time Reservations.
If you need to change or cancel a successfully booked Tee Time Reservation, you must do so directly with the golf course or applicable booking provider.
You are responsible for knowing and complying with the course’s cancellation policy and for any cancellation fees, no-show charges, or other amounts imposed by the course.
Canceling your Birdie Booking subscription, deleting your Birdie Booking account, canceling another Booking Request, or otherwise stopping use of Birdie Booking does not cancel any Tee Time Reservation that has already been made.
8. Course Charges and No-Shows
You are responsible for charges imposed by a golf course or booking provider in connection with an authorized Tee Time Reservation.
This includes, where applicable, green fees, booking fees, deposits, cancellation charges, and no-show charges.
A course or third-party booking provider may charge a payment method stored with your third-party account according to its own policies. Birdie Booking does not control those charges.
You are responsible for managing or canceling a Tee Time Reservation directly with the applicable golf course or booking provider.
Repeated no-shows, late cancellations, or other conduct may result in restrictions or suspension by a golf course or booking provider. Those decisions are outside Birdie Booking’s control.
9. Duplicate and Unwanted Reservations
Birdie Booking may continue working on an active Booking Request until the request is successfully completed, canceled, expires, or is otherwise closed.
If you manually reserve a tee time elsewhere, change your plans, or otherwise no longer want Birdie Booking to make the requested reservation, you are responsible for canceling the active Booking Request through Birdie Booking.
If your Booking Request remains active and Birdie Booking successfully reserves a tee time that satisfies the criteria you authorized, that Tee Time Reservation is considered an authorized booking.
For example, manually booking another tee time does not automatically cancel your Birdie Booking Booking Request.
If this results in multiple reservations, you are responsible for canceling any Tee Time Reservation you no longer intend to use directly with the applicable golf course or booking provider.
If you believe Birdie Booking created a duplicate or incorrect Tee Time Reservation because of an error in our Service rather than because an active Booking Request remained in place, contact us as soon as reasonably possible so we can investigate.
10. Third-Party Services and Accounts
Birdie Booking depends on websites, software, booking platforms, golf courses, payment processors, hosting providers, and other services operated by third parties.
Your use of those services may be subject to separate agreements, terms, privacy policies, membership requirements, and other rules established by those third parties.
You remain responsible for complying with the terms that apply to your accounts and Tee Time Reservations.
Birdie Booking does not control third-party services and cannot guarantee that any particular golf course or booking platform will remain compatible with Birdie Booking.
A third party may change its website, technology, policies, access requirements, booking procedures, or other features at any time.
We may add, remove, suspend, or modify support for a golf course or booking provider at any time, including if continued access becomes unavailable, unreliable, restricted, or impractical.
11. Golf Course Credentials
Some golf courses require an account or login before a Tee Time Reservation can be made.
If you provide Birdie Booking with credentials for such an account, you authorize us to store and use those credentials as reasonably necessary to provide the Service.
You represent that the credentials belong to you or that you are otherwise authorized to use them.
You are responsible for keeping those credentials accurate and current.
How we collect, store, protect, and use account information and credentials is described further in our Privacy Policy.
12. Subscriptions and Billing
Birdie Booking may offer free and paid subscription plans.
The features, Booking Request allowances, active-request limits, pricing, and other benefits associated with each plan are described when you subscribe and may vary by plan.
Automatic Renewal
Unless otherwise stated when you subscribe, paid subscriptions automatically renew until canceled.
If you select a monthly subscription, you will generally be charged at the beginning of each monthly billing period.
If you select an annual subscription, you will generally be charged at the beginning of each annual billing period.
By purchasing an automatically renewing subscription, you authorize our payment processor to charge your selected payment method for each renewal until you cancel.
Subscription Cancellation
You may cancel your Birdie Booking subscription at any time through the subscription or account-management tools provided by Birdie Booking.
Canceling your subscription stops future subscription renewals. Unless otherwise stated or required by law, your paid access continues through the end of the billing period you have already paid for.
Canceling your Birdie Booking subscription does not cancel any Tee Time Reservation already made with a golf course.
Deleting the Birdie Booking application, stopping use of Birdie Booking, or canceling a Booking Request does not by itself cancel your subscription.
Refunds
Subscription payments are nonrefundable except where required by law or where Birdie Booking expressly agrees otherwise.
Canceling during a paid billing period generally does not result in a prorated refund for the unused portion of that period.
Price Changes
We may change subscription prices.
If we change the price that applies to an automatically renewing subscription, we will provide advance notice as required by applicable law. The new price will apply to a future renewal rather than retroactively to a billing period you have already purchased.
You may cancel before the new price takes effect.
Failed Payments
If a subscription payment fails, we may retry the payment, ask you to update your payment information, limit paid features, or suspend the subscription until payment is completed.
Taxes
Prices may not include applicable sales, use, or other taxes unless stated otherwise. You are responsible for applicable taxes associated with your purchase where required.
13. Free Trials and Promotions
Birdie Booking may offer free trials, promotional subscriptions, discount codes, free Booking Request credits, or other promotions.
Additional terms presented with a promotion are part of these Terms.
Unless otherwise stated, promotions:
- have no cash value;
- may not be transferred or resold;
- may be limited to one per person or account;
- may have an expiration date; and
- may be modified or withdrawn in cases of misuse, fraud, or error.
If a free trial automatically converts into a paid subscription, we will disclose the applicable price, renewal terms, and cancellation method when you enroll.
You must cancel before the applicable deadline if you do not want the subscription to convert or renew.
14. Acceptable Use
Birdie Booking is intended to help golfers reserve tee times they genuinely intend to use.
You may not use Birdie Booking to:
- intentionally hoard tee times you do not intend to use;
- resell or commercially transfer reservations where prohibited;
- evade a golf course’s booking limits or eligibility rules;
- book for someone who has been barred or restricted by a course;
- access an account you are not authorized to use;
- provide credentials or payment information you are not authorized to use;
- create fraudulent or misleading accounts;
- circumvent subscription limits or other Service restrictions;
- scrape, probe, attack, overload, disrupt, or interfere with Birdie Booking;
- reverse engineer or attempt to extract nonpublic source code from the Service except where applicable law expressly permits it;
- use automated tools to access Birdie Booking in a manner we have not authorized;
- use the Service to violate applicable law or another person’s rights; or
- use Birdie Booking in a way that creates unreasonable risk to Birdie Booking, golf courses, booking providers, or other golfers.
We may investigate suspected misuse and may limit, suspend, or terminate accounts that violate these Terms.
15. Service Availability and Changes
We want Birdie Booking to be available when you need it, but no online service operates perfectly at all times.
We do not guarantee uninterrupted or error-free availability.
We may maintain, modify, update, suspend, or discontinue all or part of the Service.
Features may change over time as golf courses, booking providers, technology, and our own products change.
We may also establish or modify reasonable limits on use of the Service, including supported courses, active Booking Requests, booking frequency, or other features.
If we discontinue a paid service or materially reduce functionality you have already purchased, we will handle the change in accordance with applicable law and any commitments presented when you purchased the applicable plan.
16. Account Suspension and Termination
You may stop using Birdie Booking at any time.
We may suspend or terminate your account if we reasonably believe:
- you violated these Terms;
- your account is being used fraudulently or without authorization;
- your use poses a security or operational risk;
- your use may harm Birdie Booking, a course, a booking provider, or another person;
- you repeatedly misuse booking functionality;
- payment for a paid subscription remains overdue; or
- we are required to do so by law or by circumstances outside our reasonable control.
Where appropriate, we may provide notice and an opportunity to correct the problem before terminating an account, but we are not required to do so where immediate action is reasonably necessary.
Suspending, terminating, or deleting your Birdie Booking account does not cancel any Tee Time Reservation that has already been made.
You remain solely responsible for changing or canceling any Tee Time Reservation directly with the applicable golf course or booking provider.
Sections of these Terms that by their nature should survive termination will continue to apply, including provisions concerning payments already owed, intellectual property, disclaimers, limitations of liability, indemnification, and disputes.
17. Privacy
Our collection and use of personal information is governed by our Privacy Policy.
By using Birdie Booking, you acknowledge that we need to process certain information to operate the Service, including information associated with your account and Booking Requests.
Where a Booking Request requires a third-party account, Birdie Booking may also process the credentials or other information necessary to access that account on your behalf as described in our Privacy Policy.
18. Intellectual Property
Birdie Booking and its software, branding, designs, text, graphics, logos, features, and other original content are owned by Birdie Booking or its licensors and are protected by applicable intellectual-property laws.
These Terms give you a limited, personal, nonexclusive, nontransferable, revocable right to use the Service for its intended purpose.
They do not transfer ownership of Birdie Booking or its intellectual property to you.
Golf course names, logos, booking-provider names, and other third-party trademarks belong to their respective owners. Their appearance within Birdie Booking does not necessarily indicate sponsorship, endorsement, or affiliation.
19. Disclaimer of Warranties
To the fullest extent permitted by applicable law, Birdie Booking is provided “as is” and “as available.”
We do not make warranties or guarantees regarding:
- the availability of any particular tee time;
- the success of any Booking Request;
- the exact timing of a booking attempt;
- uninterrupted or error-free operation;
- the continued availability of any course or booking provider;
- the accuracy of information supplied by a course or third party; or
- the performance, availability, or conduct of golf courses and third-party services.
We disclaim warranties of merchantability, fitness for a particular purpose, noninfringement, and other warranties to the extent permitted by law.
Nothing in these Terms excludes any warranty or consumer right that cannot legally be excluded.
20. Limitation of Liability
To the fullest extent permitted by applicable law, Birdie Booking and its owners, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the Service.
This includes, without limitation, losses resulting from:
- an unsuccessful Booking Request;
- an unavailable tee time;
- a delayed booking attempt;
- a golf course changing or canceling a Tee Time Reservation;
- a missed round of golf;
- travel or lodging costs;
- lost enjoyment or opportunity;
- a third-party website or service outage;
- a golf course cancellation or no-show fee;
- failure to cancel a Tee Time Reservation directly with the golf course or booking provider;
- an account restriction imposed by a golf course or booking provider; or
- unauthorized third-party access that could not reasonably have been prevented by Birdie Booking.
To the fullest extent permitted by applicable law, Birdie Booking’s total liability for all claims arising out of or relating to the Service will not exceed the greater of:
(a) the amount you paid Birdie Booking during the 12 months immediately preceding
the event giving rise to the claim; or
(b) $100.
These limitations apply regardless of the legal theory on which a claim is based and even if Birdie Booking has been advised that a loss was possible.
Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, these provisions apply only to the maximum extent permitted by law.
Nothing in these Terms limits liability that cannot legally be limited.
21. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Birdie Booking and its owners, officers, employees, contractors, and affiliates from claims, losses, liabilities, damages, and reasonable expenses arising from:
- your intentional misuse of the Service;
- your violation of these Terms;
- your use of an account, credential, payment method, membership, or other information you were not authorized to use;
- your violation of applicable law; or
- your infringement of another person’s rights.
This section does not require you to indemnify Birdie Booking for claims caused by Birdie Booking’s own unlawful conduct where such an obligation would be prohibited by law.
22. Governing Law and Disputes
These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Before filing a lawsuit relating to Birdie Booking, we encourage you to contact us so we can attempt to resolve the issue informally.
Unless applicable law provides otherwise, legal proceedings arising out of or relating to these Terms or the Service may be brought in the state or federal courts located in Minnesota, and you and Birdie Booking consent to the jurisdiction of those courts.
Nothing in this section prevents either party from bringing an eligible matter in small claims court or exercising rights that cannot legally be waived.
23. Changes to These Terms
We may update these Terms from time to time.
If we make a material change, we will provide notice before the change takes effect where required by applicable law.
The notice may be provided through the Service, by email, or through another reasonable method.
The updated Terms will identify their effective date.
Your continued use of Birdie Booking after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.
If you do not agree to an updated version, you should stop using Birdie Booking and cancel any subscription before the applicable renewal date.
Changes to subscription pricing, automatic renewal terms, or other material subscription terms will also be communicated as required by applicable law.
24. Electronic Communications
By using Birdie Booking, you agree that we may provide transactional notices and other communications electronically, including by email and through the Service.
These communications may include:
- account verification;
- Booking Request updates;
- Tee Time Reservation confirmations;
- security notices;
- subscription confirmations;
- billing and renewal notices;
- changes to the Service; and
- changes to these Terms or our Privacy Policy.
You are responsible for keeping your email address current.
Marketing communications are handled separately and may be subject to additional consent and unsubscribe options.
25. Miscellaneous
These Terms, together with our Privacy Policy and any additional terms expressly presented for a particular feature, plan, or promotion, form the agreement between you and Birdie Booking regarding the Service.
If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
Our failure to enforce a provision does not waive our right to enforce it later.
You may not transfer your rights or obligations under these Terms without our consent.
We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or transfer of the Birdie Booking business.
Headings are included for convenience and do not affect interpretation of these Terms.
